From JPL’s Website: Your Rights
What They Wrote | Our Response |
Understanding your legal rights under Section 7 of the National Labor Relations Act (NLRA) is the first step in making an informed, educated decision about unionization and how it might impact you. | Agreed. We have also provided more information about your rights on our FAQ. |
Section 7 of the NLRA protects an individual’s right to engage – or not to engage – in union support, membership, and other protected concerted activities. | Correct. Here is more information from the NLRA: “You have the right to form, join or assist a union. You have the right to organize a union to negotiate with your employer over your terms and conditions of employment. This includes your right to distribute union literature, wear union buttons, t-shirts, or other insignia (except in unusual "special circumstances"), solicit coworkers to sign union authorization cards, and discuss the union with coworkers.” |
Your decision to support or not support unionization will in no way impact your employment. | Per the NLRA: “Supervisors and managers cannot spy on you (or make it appear that they are doing so), coercively question you, threaten you or bribe you regarding your union activity or the union activities of your co-workers. You can't be fired, disciplined, demoted, or penalized in any way for engaging in these activities.” It is unlawful for an employer to interfere with, restrain, or coerce employees in the exercise of their rights (including terminating union organizers or supporters without cause). We have a large number of people already publicly supporting JWU-UAW, and the more people who are involved, the safer it becomes. |
You have the right to…Sign or not sign a union authorization card or petition | Yes, it is entirely up to you to choose to sign a card. We encourage all JPL employees to make an informed decision about unionization. JPL Workers United-UAW organizers belong to every division of the lab. We are motivated by a collective desire to improve working conditions for us and all of our colleagues. We are choosing to have conversations with colleagues to ensure everyone is fully informed and has their questions answered about signing a card. |
You have the right to…Ask for your signed union authorization card to be returned to you | JWU-UAW fully supports the rights of individuals to make informed decisions at all steps of this process. You are always welcome to contact us at info@jplworkersunited.org |
You have the right to…Refrain from any union activity | You have the right to make an informed decision on whether or not you want to participate in union activity. We believe that there are many benefits to all standing up together; we want to hear everyone’s voice! |
You have the right to…Engage in union activity and support the union | Agreed. It is a huge grassroots effort to organize a union, and takes hundreds of conversations, individual outreach, and creating the opportunity for everyone to get involved. Many of us across JPL have been having lots of conversations with co-workers about our campaign, to ensure everyone has the option to sign up, have questions answered, or learn more about how to get involved. If you would like to get involved, please fill out our get involved form. |
You have the right to…Campaign for or against the union | Agreed, and despite prior implications, JPLers are allowed to discuss unionization at work, just as we can discuss other non-work topics in the workplace. Your right to this is legally protected by the National Labor Relations Act: “your employer cannot prohibit you from talking about the union during working time if it permits you to talk about other non-work-related matters during working time”. |
The National Labor Relations Act also: Forbids the union and the employer from interfering with employees’ protected rights such as supporting or opposing the union | Please see the previous two answers. |
The National Labor Relations Act also: Gives employees the right to file unfair labor practice charges for violations of these rights. If you believe your rights have been violated, you may contact Human Resources and/or the regional office of the National Labor Relations Board (NLRB). | Yes - if you believe your rights have been violated, please reach out to info@jplworkersunited.org. |
